GhostAnswer Terms of Service

1. The Service and your licence

GhostAnswer grants you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for as long as your account or subscription is active. The Service is licensed to you, not sold, and all rights not expressly granted are reserved.

1.1. Subject to these Terms, you may:

• access and use the Service for your own personal, non-commercial purposes;
• receive AI-generated suggestions during a session and use them at your own discretion;
• install and run the GhostAnswer application on devices you own or control.

1.2. GhostAnswer may:

• modify, add to or discontinue features of the Service;
• set or change the usage limits that apply to a plan;
• suspend or terminate access in accordance with these Terms;
• decline to open an account where doing so would breach these Terms or applicable law.

2. Your account and obligations

When you use the Service, you agree to:

• provide accurate registration information and keep it up to date;
• keep your account credentials confidential and secure;
• use a single account, and not create additional accounts to obtain benefits you are not entitled to;
• not share, resell, sublicense or otherwise transfer access to your account;
• not use the Service for any unlawful purpose or in breach of rules that apply to you;
• not attempt to circumvent technical limits, security measures or usage quotas;
• not use automated scripts, scrapers or bots with the Service without the written consent of GhostAnswer.

3. What we commit to

GhostAnswer undertakes to:

• make reasonable efforts to keep the Service available, except where an interruption is outside our control;
• apply reasonable technical and organisational measures to protect accounts and data;
• respond to support requests within a reasonable time.

4. Acceptable use

You must not use the Service to:

• break the law, infringe the rights of others, or facilitate fraud or deception;
• gain an advantage in an examination, certification, assessment or hiring process where the rules of that process prohibit outside assistance;
• record, transcribe or otherwise process a conversation where you do not have the consent or the legal right to do so;
• upload malicious code, probe or scan our systems, or interfere with the operation of the Service or with other users.

5. Intellectual property

The Service, including its software, interface, design, prompts, model configurations, documentation and brand features, belongs to GhostAnswer or its licensors and is protected by intellectual property law. These Terms grant you a licence to use the Service, not any ownership interest in it.

You keep whatever rights you already have in the content you provide to the Service, including audio, transcripts and text you enter. You grant GhostAnswer a limited licence to process that content solely in order to operate, secure and support the Service.

Suggestions generated for you may be used freely for your own purposes. Similar or identical output may be generated for other users, and we make no claim that generated output is unique or protectable.

If you send us feedback or ideas, we may use them without restriction and without any obligation to you.

6. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, GhostAnswer disclaims all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

The Service relies on speech recognition and large language models. Its output is probabilistic and may be incomplete, inaccurate or out of date. You are responsible for reviewing any suggestion before you rely on it.

GhostAnswer does not warrant that the Service will be uninterrupted or error-free, or that it will produce any particular result, including success in an interview, assessment or hiring process.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

7. Limitation of liability

To the fullest extent permitted by law, GhostAnswer will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, opportunity, goodwill or data, arising out of or in connection with your use of the Service.

The total aggregate liability of GhostAnswer arising out of or in connection with these Terms is limited to the amount you paid for the Service during the twelve months before the event that gave rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for the statutory rights of consumers.

You are responsible for the consequences of how you use the Service and any output it generates, including any breach of rules set by an employer, examination body, platform or counterparty.

8. Suspension and termination

You can stop using the Service at any time, and you can ask us to delete your account by writing to hi@ghostanswer.ai.

We may suspend or terminate your access, with notice where that is reasonably possible, if you breach these Terms, if your use creates a security or legal risk, if a payment fails, or if we are required to do so by law.

If we terminate your account without cause, we will refund the unused part of any billing period you have already paid for. If we terminate it because you breached these Terms, no refund is due.

The sections on intellectual property, disclaimers, limitation of liability and governing law survive termination.

9. Changes to the Service and these Terms

We may change, add to or discontinue parts of the Service. Where a change materially reduces the core functionality of a plan you have paid for, you may cancel and ask for a refund of the unused part of the current billing period.

We may amend these Terms. The current version is always published on this page together with the date it was last updated. Material changes take effect no earlier than the date of publication, and we will give you notice through the Service or by email before they apply to you.

Continuing to use the Service after a change takes effect means you accept the amended Terms. If you do not accept them, you must stop using the Service and may cancel your subscription.

1. Definitions

1.1. Service — the GhostAnswer AI assistant, available through the web platform and the desktop application.

1.2. Subscription — paid access to the features of the Service included in a selected plan, for a defined period.

1.3. Billing Period — the period covered by a single subscription payment, for example one month or one year.

1.4. Fees — the amount payable for a Subscription for one Billing Period, as displayed at the time of purchase.

1.5. Auto-renewal — the automatic charge for the next Billing Period at the end of the current one. Auto-renewal is enabled when you first purchase a Subscription.

1.6. Account — your personal account in the Service, through which a Subscription is activated and managed.

1.7. Access — the right to use the functionality of the Service included in the plan you have paid for.

1.8. Erroneous charge — a charge taken without Access being granted, or a duplicate charge for the same Billing Period.

2. Purchasing and activating a Subscription

2.1. Subscriptions are paid for in advance for the selected Billing Period.

2.2. By purchasing a Subscription you authorise us and our payment provider to charge the Fees for each following Billing Period automatically, at the price then in effect, until you cancel. We will notify you in advance if the renewal price changes.

2.3. When Access is delivered

Access is treated as delivered when the payment is processed successfully and the Subscription is activated in your Account.

Access is treated as delivered in full regardless of how much you actually use the Service during the Billing Period.

3. Restrictions

You must not:

• give third parties access to your Subscription;
• use the Subscription for commercial purposes without the written consent of GhostAnswer;
• attempt to circumvent the technical limits of the Service;
• use the Subscription in any way these Terms do not permit.

4. Fees and refunds

4.1. Fees are charged in advance. Unless stated otherwise at checkout, prices include any taxes we are required to collect.

4.2. Because Access is delivered when the Subscription is activated, Fees for a Billing Period that has started, including an automatically renewed period, are non-refundable except as set out below or where mandatory consumer law gives you a right to a refund.

4.3. We refund Fees in the following cases:

• an erroneous charge;
• a duplicate charge;
• a charge taken without Access being granted through the fault of GhostAnswer.

4.4. If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from a distance contract within 14 days. By starting to use the Service during that period you ask us to begin supplying it immediately and acknowledge that the right of withdrawal is lost once the Service has been supplied in full.

4.5. GhostAnswer may, at its discretion, issue a refund or instead extend the Subscription by an equivalent period.

5. Cancellation

5.1. You can cancel your Subscription at any time in your account settings, or by writing to hi@ghostanswer.ai.

5.2. Cancellation stops future automatic charges. Access continues until the end of the Billing Period you have already paid for.

5.3. Cancelling does not by itself entitle you to a refund of Fees already paid.

6. Changes to plans and pricing

GhostAnswer may change the features included in a plan and the Fees payable for it.

Changes take effect when they are published on the GhostAnswer website and apply to Billing Periods beginning after publication. If you do not accept a change, you can cancel before the next renewal.

7. Final provisions

We would prefer to resolve any complaint directly. Before starting formal proceedings, please contact us at hi@ghostanswer.ai so that we can try to settle the matter.

• If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions stay in force.
• These Terms are governed by the laws of the Emirate of Abu Dhabi, United Arab Emirates, without regard to conflict of law rules.
• Disputes will be submitted to the courts of Abu Dhabi, United Arab Emirates. Nothing in these Terms removes any right you have as a consumer to bring a claim in the courts of your country of residence or to use a dispute resolution scheme available to you there.
